2019/1158 (EB) Zuzentarauak, 5/2023 Errege Lege Dekretuaren bidez Espainian ezarri zenak, aldaketa garrantzitsuak egin zituen lanaldia egokitzeko eskubidean ( 34.8 ET). Lehenik eta behin, subjektu eragileak zabaldu zituen, eta seme-alaba adingabeak ez ezik, laguntza behar duten beste senide edo bizikide batzuk ere zaintzeko egokitzapenak eskatzeko aukera eman zuen. Bigarrenik, langilearen eta enpresaren arteko negoziazio-epea murriztu zuen, eta egokitzapen-eskaeraren aurreko lan-baldintzetara itzultzeko eskubidea indartu zuen, egokitzapena amaitzean edo egokitzapena justifikatu zuten inguruabarrak aldatzen direnean. Azkenik, 5/2023 Errege Lege Dekretuak lanaldia egokitzeko kasuetan kaleratzearen deuseztasun objektibo automatikoa ere jaso zuen, nahiz eta neurri hori duela gutxi indargabetu zen, eskubide hori baliatzen dutenen babesa ahulduz eta Zuzentarauaren espiritua urratuz.
Directive (EU) 2019/1158, transposed in Spain by Royal Decree-Law 5/2023, introduced important changes to the right to adapt the working day (art. 34.8 Workers´ Statute). Firstly, it expanded the eligible beneficiaries, allowing employees to request adaptations not only for the care of minor children but also for other family members or cohabitants who need assistance. Secondly, it reduced the period of negotiation between the employee and employer and reinforced the right to return to prior working conditions once the adaptation period concludes or when circumstances change. Finally, RD-Law 5/2023 also incorporated the automatic objective nullity of dismissal in cases of adaptation of working hours, although this measure was recently repealed, weakening the protection of those who exercise this right and contravening the spirit of the Directive.
