La competencia de la víctima como criterio delimitador de la imputación penal desde la perspectiva victimodogmática

    En algunos tipos penales la víctima puede tener cierta participación en la configuración del hecho punible, y consecuentemente en la imputación objetiva del sujeto activo, cuando se dan determinadas circunstancias de imputabilidad en que puede existir favorecimiento de una autopuesta en peligro, o cuando la víctima acepta el riesgo, pero no el resultado típico que causa daño al bien jurídico protegido. Esos presupuestos colocan a la víctima en el centro de la reflexión sobre la autoría, especialmente cuando es ella quien tiene el control del riesgo, siendo este el criterio que se utiliza para distinguir entre el riesgo compartido entre la víctima y el tercero que da cabida a la imputación objetiva. En ese contexto, el autor analiza la influencia de la intervención de la víctima en el supuesto fáctico y la creación del riesgo imputable a sí misma o a terceras personas relacionadas con el hecho punible.

    In some types of criminal offenses, the victim may have a certain participation in the configuration of the punishable act, and consequently in the objective imputation of the active subject, when certain circumstances of imputability occur in which there may be favoring of a self-endangerment, or when the victim accepts the risk, but not the typical result that causes damage to the protected legal good. These assumptions place the victim at the center of the reflection on authorship, especially when she isthe one who has control of the risk, this being the criterion used to distinguish between the shared risk between the victim and the third party that allows for objective imputation. In this context, the author analyzes the influence of the victim's intervention in the factual assumption and the creation of the risk attributable to herself or to third parties related to the punishable act.
