    La sentencia y las Decisiones de abril de 2024 en los asuntos KlimaSeniorinnen, Duarte Agostinho y Carême materializan la llegada de la litigación climática al Tribunal de Estrasburgo. Sin embargo, la naturaleza del sistema de la Convención conlleva diferencias respecto al tratamiento a dar a ese tipo de asuntos en relación a otros foros internacionales. Esas diferencias se sintetizan en la necesidad del Tribunal de mantener un equilibrio entre el sentir social respecto de la litigación climática y los impactos de esos asuntos en su funcionamiento. Este estudio se centra en el análisis de cómo el Tribunal ha intentado mantener ese equilibrio en el contexto de sus primeros pronunciamientos en asuntos climáticos, marcando el camino para lo que pueda llegar con posterioridad.

    The April 2024 judgment and Decisions in the KlimaSeniorinnen, Duarte Agostinho and Carême cases materialize the arrival of climate litigation at the Strasbourg Court. However, the nature of the Convention system entails differences in the treatment of such cases in relation to other international forums. These differences are summarized in the need for the Court to maintain a balance between social perception regarding climate litigation and the impacts of those cases on its operation. This study focuses on the analysis of how the Court has attempted to maintain this balance in the context of its first statements on climate cases, paving the way for what it can achieve later.
