The Civil Code states that the legatee of a specific and determined thing, belonging to the testator, acquires its property from the moment of the death of the deceased (art. 882), but cannot occupy the thing bequeathed by his own authority, but must request delivery to the persons authorized to do so (executor or accountant or, failing that, to the heirs. art. 885). Of particular relevance is the study of mortgage regulations in order to register legacies in the Property Registry and the positions of the General Directorate of Social Security and Public Faith and the Supreme Court in this matter, as well as addressing the issues that arise given the lack of correspondence between civil and registry regulations, proposing to arbitrate more flexible and effective procedures for the registration of legacies.
