La función notarial de apoyo a las personas con discapacidad: especial referencia a la digitalización notarial

    El notario se ha convertido en un apoyo institucional fundamental en el ejercicio de la capacidad jurídica de las personas con discapacidad en condiciones de igualdad con los demás. El juicio notarial de capacidad o mejor llamado «de aptitud o de discernimiento» es la piedra angular del nuevo sistema de seguridad y se debe adaptar a las personas que necesiten apoyos para la formación de su voluntad, garantizando su accesibilidad cognitiva. La Ley 11/2023, de 8 de mayo, es la causa de la digitalización notarial y permite en determinados actos que la comparecencia del otorgante sea por videoconferencia. La intervención telemática de la persona con discapacidad debe ser realizada con mayor cautela para garantizar la autonomía y evitar influencias indebidas o conflictos de intereses.

    The notariy has become a fundamental institutional support in the exercise of the legal capacity of people with disabilities on equal terms with others. The notarial judgment of capacity or better called «aptitude or discernment» is the cornerstone of the new security system, and it must be adapted to people who need support to form their will, guaranteeing their cognitive accessibi lity. Law 11/2023, of May 8, is the cause of notarial digitalization and allows in certain acts that the appearance of the grantor be by videoconference. The telematic intervention of the disabled person must be carried out with greater caution to guarantee autonomy and avoid undue influences or conflicts of interest.
