    Este estudio tuvo como objetivo analizar las repercusiones de la Sentencia N° 34-19 IN/21, que despenaliza parcialmente el aborto en casos de violación en el marco jurídico y social del país. A través de una investigación documental bajo un enfoque cualitativo, se examinan la normativa constitucional, la jurisprudencia pertinente y los obstáculos para la implementación efectiva de la sentencia. Los resultados evidencian que este recurso jurisprudencial representa un avance significativo en los derechos sexuales y reproductivos de las mujeres; sin embargo, se siguen presentando limitaciones relacionados a la falta de recursos en el sistema de salud y la resistencia cultural, que dificultan la plena implementación de los derechos reconocidos por la sentencia. En conclusión, para que la sentencia tenga un impacto real, es fundamental que el Estado, el sistema de salud y la sociedad civil trabajen juntos para garantizar el acceso seguro y efectivo a los servicios de aborto, asegurando así la protección de los derechos reconocidos.

    This study aimed to analyze the repercussions of Sentence No. 34-19 in/21, which partially decriminalizes abortion in cases of rape, in the legal and social framework of the country. Through a documentary under a qualitative approach, the constitutional regulations, the relevant jurisprudence and the obstacles to the effective implementation of the ruling are examined. The results show that this jurisprudence represents a significant advance in the sexual and reproductive rights of women, however, there are still limitations related to the lack of resources in the health system and cultural resistance, which hinder full implementation. of the rights recognized by the ruling. In conclusion, for the ruling to have a real impact, it is essential that the State, the health system and civil society work together to guarantee safe and effective access to abortion services, thus ensuring the protection of recognized rights.
