    En este trabajo se realiza un análisis acerca de la naturaleza jurídica de las plataformas electrónicas más utilizadas en el sector turístico. Concretamente, nos centramos en determinar si Airbnb y otras plataformas, deben someter su actividad a las normas sobre servicios de la sociedad de la información o, si, por el contrario, deben cumplir la legislación sobre arrendamientos de viviendas turísticas, transporte, o cualesquiera otras reguladoras de la actividad subyacente que imperan en cada uno de los Estados en los que prestan sus servicios. Se estudia el tipo de servicio de intermediación que presta la plataforma y se analiza si dicho servicio forma parte de un servicio global (arrendamiento, actividad turística, etc.) que sea merecedor de otra calificación jurídica.

    La importancia de este análisis se encuentra fuera de toda duda, pues de la calificación jurídica que realicemos dependerá la normativa a la que estas plataformas han de someterse en el ejercicio de su actividad.

    In this work, an analysis is made of the legal nature of the most widely used electronic platforms in the tourism sector. Specifically, we focus on determining whether Airbnb and Uber, among others, should subject their activity to the rules on informationsociety services or, on the contrary, whether they should comply with the legislation on tourist accommodation, transport, or any other legislation regulating the underlying activity in each of the states where they provide their services.The type of intermediary service provided by the platform is studied and it is analysed whether this service is part of an overall service (rental, tourist activity, etc.) that deserves another legal qualification.The importance of this analysis is beyond doubt, since the regulations to which these platforms must submit in the exercise of their activity will depend on the legal classification they receive.
