  La Convención sobre los Derechos de las Personas con Discapacidad establece un trascendental cambio de paradigma en la regulación de la capacidad jurídica, que consiste en el reconocimiento de la capacidad de ejercicio de las personas en situación de discapacidad, y en el paso del sistema de sustitución al sistema de apoyo en la toma de decisiones. En el presente trabajo se pretende dar cuenta de la regulación de la capacidad jurídica en el derecho chileno, y el impacto que provoca este enfoque basado en derechos. Por último, el artículo busca reflexionar sobre algunas cuestiones que podrían ser significativas para la plena efectividad del artículo 12 de la Convención en nuestro país.

  The Convention on the Rights of the Persons with Disability establishes a far-reaching change of paradigm in the regulation of the legal capacity that consists in the recognition of capacity of exercise of persons with disability and in the change from the system of substitution to the system of support in decision-making. This article aims to present the regulation of the legal capacity in the Chilean law system and the impact that this rights-based approach causes. Finally, it invites to reflect upon some issues that may be significant for the full application of the article 12 of the Convention in our country.
