    El presente artículo tiene por objetivo: realizar un análisis teórico doctrinal, legislativo en la Constitución cubana de 1976, de los derechos humanos en las tendencias del nuevo constitucionalismo latinoamericano. El artículo está estructurado en tres epígrafes. El epígrafe I a modo de introducción, en el epígrafe II se desarrollan elementos teóricos doctrinales de los derechos humanos, su evolución histórica, características, diferentes terminologías; así como su clasificación y caracterización. El epígrafe III aborda cómo se regulan los Derechos Humanos en el nuevo constitucionalismo latinoamericano, las características generales que presentan en las constituciones latinoamericanas y las nuevas tendencias que rompe con las anteriores atemperándose a la sociedad moderna. El epígrafe IV hace referencia a los Derechos Humanos en la Constitución cubana, su regulación jurídica, características y el tratamiento que se le otorga en torna a la problemática existente de jerarquización de derechos en la constitución por cuestiones técnicas legislativas.

    The present article has as objective a doctrinal theory and legislative analysis in the Cuban constitution of 1976, of the human rights in the tendencies of the new latinoamerican constitutionalism. The article is structured into three charters. The charter I where are developed doctrinal theories elements of the human rights, its historical evaluation, characteristics, different terminologies, as well as classification and characterization of them .Charter II treats about how are regulated the human rights in the new latinoamerican constitutionalism and the general characteristics that present in the latinoamerican constitution and the new tendencies that broke with the last one being in correspondence with the modern society. Charter III refers to the human rights in the Cuban constitution, its juridical regulation characteristics and treatment that is given in relation to the existing problematic of jerarquization to legislative techniques reasons.
