One of the most novel topics in the establishment of technology in the field of law and which lacks a great deal of jurisprudential and regulatory precedent is the phenomenon of non-fungible tokens. With the arrival of these new digital products on the market, a series of circumstances and questions arise that once again highlight the need for the law to advance at the pace of the changing reality it seeks to regulate. Following a recent ruling by the New York federal court in which Hermès set a legal precedent, this study examines the problems that arise in relation to the collision between NFTs, as a digital file that represents, or may represent, a pre-existing right, and trademark law.
