    El derecho de la Unión ha contribuido a aumentar el radio de acción de la libertad de empresa a través de distintas vías, desde las libertades de los Tratados a la acción del legislador europeo. En este trabajo se descubre una nueva contribución de ese ordenamiento a la protección de esa libertad, en esta ocasión a través del necesario refuerzo de la vía de acceso a su tutela judicial. El trabajo analiza de qué manera el interesado tiene acceso a tal tutela en el ordenamiento Español y concluye que, a la luz de la doctrina del Tribunal de Justicia en la sentencia Unibet, un particular en España no goza de una tutela adecuada cuando pretende cuestionar ante los Tribunales las medidas legislativas restrictivas de la libertad de empresa.

    EU law has contributed to increasing the scope of action of the freedom to conduct a business through different ways, from the freedoms of the Treaties to the action of the European legislator. This paper identifies a new contribution of EU law to the protection of this freedom, this time through the necessary reinforcement of its means of access to judicial protection. The paper analyses how the interested party has access to such protection in the Spanish legal system and concludes that, in the light of the doctrine of the Court of Justice in the Unibet judgment, a private individual in Spain does not enjoy adequate protection when seeking to challenge legislative measures restricting the freedom to conduct a business before the courts.
