    En la administración de justicia en América Latina en su devenir histórico-evolutivo, el denominador común ha sido considerar los cargos judiciales como un modo de repartir el establishment político, adicionalmente la justicia en la región se ha visto afectado por conflictos de orden sociopolítico, trayendo esto como consecuencia un impacto negativo en la heterogeneidad y disimilitud en las decisiones judiciales. Por ello, esta investigación procura como propósito –a través del análisis hermenéutico-valorativo documental- reflexionar sobre la afectación de la corrupción en la independencia e imparcialidad del sistema judicial en la región. Se discute un constructo vinculante sobre el estado del arte de la corrupción en el sistema de justicia, las formas de corrupción y su vinculación con la percepción ciudadana. Finalmente los hallazgos muestran la perdida de credibilidad y confiabilidad del sistema de justicia debido al desgaste producido por la misma inacción de la justicia ante casos emblemáticos y comunes ocurridos en los últimos años en la región.

    The administration of justice in Latin America in its historical-evolutionary development, the common denominator has been to consider judicial positions as a way of distributing the political establishment; additionally, justice in the region has been affected by socio-political conflicts, bringing this as consequently a negative impact on the heterogeneity and dissimilarity in judicial decisions. Therefore, the purpose of this research is to reflect on the impact of corruption on the independence and impartiality of the judicial system in the region through documentary hermeneutical-evaluative analysis. A binding construct is discussed on the state of the art of corruption in the justice system, the forms of corruption and its connection with citizen perception. Finally, the findings show the loss of credibility and reliability of the justice system due to the wear and tear produced by the inaction of justice in the face of emblematic and common cases that have occurred in recent years in the region.
