    En el presente artículo se examina la intersección entre los sistemas de gestión procesal, la inteligencia artificial (IA) generativa y la justi-cia orientada al dato, desde una perspectiva crítica y propositiva. En un primer momento, realizamos un análisis de los principales debates jurídicos que surgen en torno a la aplicación de la IA en el sistema judicial, algunos de ellos pocos tratados hasta el momento a nivel doctrinal, y que pensamos condicionan el tratamiento jurídico de esta realidad, al tiempo que se ponen de relieve tanto las oportunidades y desafíos que esta tecnología lleva aparejado a nivel legal.En cuanto a los sistemas de gestión procesal, se aborda su evolución frente a la IA generativa y la justicia orientada al dato. Se parte del potencial que estas dos técnicas para optimizar la gestión procesal y aumentar la eficiencia de la propia administración de justicia, al tiempo que se plantean los principales riesgos que las mismas llevan aparejadas.El artículo también aborda las principales incidencias del Real Decre-to-ley 6/2023, de 19 de diciembre y del Reglamento de Inteligencia Artificial (RIA) en los programas de gestión procesal informatizada. Se enfatiza la importancia de un tratamiento adecuado de los datos, así como la necesidad de establecer un marco de gobernanza que pro-mueva la transparencia y la responsabilidad en el uso de la IA como medida esencial para asegurar que los propios sistemas encajen de manera adecuada en nuestro Estado de derecho

    This article examines the intersection between procedural management systems, generative artificial intelligence (AI) and data-driven justice from a critical and proactive perspective. First, we analyze the main legal debates that arise around the application of AI in the judicial system, some of which have been little addressed so far at the doctrinal level, and which we believe condition the legal treatment of this reality, while highlighting both the opportunities and challenges that this technology brings with it at the legal level.With regard to procedural management systems, its evolution in the face of generative AI and data-driven justice is addressed. The potential of these two techniques to optimize procedural management and increase the efficiency of the administration of justice itself is discussed, while at the same time the main risks associated with them are raised.The article also addresses the main incidences of the Real Decreto-ley 6/2023, 19 of december, and the Artificial Intelligence Regulation (RIA) in computerized procedural management programs. The importance of proper data handling is emphasized, as well as the need to establish a governance framework that promotes transparency and accountability in the use of AI as an essential measure to ensure that the systems themselves fit properly within our rule of law
