Ambato, Ecuador
The study analyzes the modalities of food provision contemplated in the Code of Childhood and Adolescence of Ecuador through a qualitative and analytical approach. The regulatory framework, jurisprudence, and interviews with specialized judges and lawyers are thoroughly examined. The judges indicate that the most applied modality is the payment of a periodic pension, considering the best interests of the beneficiary, socioeconomic circumstances, and age. They identify challenges such as the lack of resources of the obligor, the complexity of verifying compliance and modifying modalities. The lawyers use argumentative strategies based on principles, jurisprudence, and socioeconomic evidence. Both groups recognize the strengths and weaknesses of each modality. It is concluded that although the Code establishes a solid framework, it is insufficient in enforcement and compliance mechanisms, requiring regulatory, procedural, and inter-institutional coordination improvements.
