    Este trabajo tiene por objeto el análisis del Laudo arbitral número 3/2023, dictado el 2 de febrero de 2024, por BITARTU, Servicio Vasco de Arbitraje Cooperativo- SVAC, en el que se plantea como cuestión litigiosa la impugnación de las liquidaciones practicadas por una Sociedad Cooperativa a los demandantes, que reclaman el reembolso de las aportaciones que realizaron en su momento al capital social, tras su expulsión y baja como socios cooperativistas. La resolución arbitral que se analiza estima de manera parcial la demanda interpuesta contra la cooperativa y estable las cantidades que ésta debe abonarles como reembolso de sus aportaciones al capital social de la cooperativa, en el plazo de cinco años, a partir de la fecha en la que se produjo la expulsión de los demandantes de la cooperativa.

    The purpose of this work is to analyze the arbitration award number 3/2023, issued on February 2, 2024, by BITARTU, Basque Cooperative Arbitration Service - SVAC, in which the challenge to the settlements carried out by a Cooperative Society to the plaintiffs, who demand reimbursement of the contributions they made at the time to the social capital, after their expulsion and withdrawal as cooperative members. The arbitration resolution that is analyzed partially estimates the claim filed against the cooperative and establishes the amounts that it must pay them as reimbursement of their contributions to the cooperative’s social capital, within a period of five years, from the date on which that the expulsion of the plaintiffs from the cooperative occurred
