Contaminación ambiental por minería informal y responsabilidad penal investigada por operadores de justicia de la Provincia del Santa 2019-2022

    El delito ambiental ha sido la explotación illegal de la minería, Tambien los delitos por posesiones de terrenos, tráfico de forestación, entre otros. Por esta razon se propuso como objetivo genral determinar la percepción de los operadores de justicia sobre la contaminación ambiental por minería informal y la responsabilidad penal investigada por el Sistema de justicia de la Provincia del Santa, 2019-2022. Es de tipo no experimental, con un enfoque cuantitativo, con diseño correlacional y transversal, la muestra estuvo conformado por 70 operadores de justicia. Los resultados señalan que, un 47% de los encuestados manifiestan que la contaminación ambiental se percibe en un nivel regular y 52,8% de los encuestados consideran que la responsabilidad penal alcanza un nivel regular. Concluye que, existe una relación positiva moderada entre la contaminación ambiental y la responsabilidad penal mediante Rho=0,641 en operadores de justicia e la Provincia del Santa, 2019-2022.

    The environmental crime has been the illegal exploitation of mining, as well as crimes for possession of land, forestry trafficking, among others. For this reason, it is recommended as a general objective to determine the perception of justice operators about environmental contamination by informal mining and criminal liability investigated by the Justice System of the Province of Santa, 2019-2022. It is of a non-experimental type, with a quantitative approach, with a correlational and cross-sectional design, the sample consisted of 70 justice operators. The results indicate that 47% of the respondents state that environmental pollution is perceived at a regular level and 52.8% of the respondents consider that criminal responsibility reaches a regular level. It concludes that there is a moderate positive relationship between environmental pollution and criminal liability through Rho = 0.641 in justice operators in the Province of Santa, 2019-2022.
