    El presente artículo tiene por objetivo examinar el papel que puede asumir la acción generalde enriquecimiento injustificado para obtener la restitución de bienes en nuestro ordenamientojurídico. Para ello se estudia cómo y cuándo la detentación de bienes ajenos constituye un enriquecimientoinjustificado y en qué casos la acción de enriquecimiento es operativa, tomando encuenta la regla de la subsidiariedad. Por último, se evalúan las ventajas del uso de la acciónde enriquecimiento en la restitución de bienes.

    The objective of this article is to examine the role that the general action of unjustified enrichmentcan assume to obtain the restitution of assets in our legal system. To this end, we study how andwhen the possession of other people’s assets constitutes unjustified enrichment and in which casesthe enrichment action is operative, taking into account the rule of subsidiarity. Finally, theadvantages of using the enrichment action in the restitution of property are evaluated.
