The Italian legal system, unlike the Spanish one, has never endowed itself with autonomous regulations on juvenile criminal matters, favouring targeted interventions whenever the minor's age signals the need for an adaptation of the general law provisions. The non-self-sufficient nature of Italian juvenile criminal law forces one to compose the concrete contents of the legal consequence for the offence committed by the minor through the combination of the general law provisions for adults and those specifically provided for minors. Nevertheless, the Spanish model, while providing an apparatus of measures of a formally penal but substantially punitive-educational nature, presents points of significant convergence with the set of provisions that the Italian legal system dedicates to the condition of minors. This paper aims to compare the most significant (substantive criminal law) profiles of the two systems, from the twofold perspective of estimating the actual practicability, in Italy, of a definitive emancipation of juvenile criminal law from that provided for adults and of unveiling the pitfalls that might lurk in a model that, like the Spanish one, configures a system of measures reserved exclusively for the minor involved in the criminal circuit.
