    Hace más de 37 años que una ley orgánica, la de Fuerzas y Cuerpos de Seguridad, encomendó a la Guardia Civil las funciones de seguridad pública en las aguas marítimas de soberanía. Sin embargo, a pesar del tiempo transcurrido y del alto nivel normativo de la disposición que recogía esa encomienda, a día de hoy se sigue poniendo en cuestión la competencia de la Guardia Civil en las aguas marítimas.

    Dicho cuestionamiento procede, básicamente, de Instituciones que, en su momento, ejercían determinadas tareas que hoy desarrolla la Guardia Civil, o de otras que reclaman competencias que el marco normativo actual no les atribuye. A continuación, se expondrán los argumentos normativos que sirven de sustento para que la Guardia Civil (sobre todo a través de las Unidades del Servicio Marítimo) cumpla las diferentes misiones y cometidos que tiene encomendado.

    More than 37 years ago the Spanish Organic Law on Law Enforcement Agencies entrusted the Guardia Civil with the public security role on maritime waters under Spanish sovereignty. However, despite the time that has elapsed and the high regulatory level of the law that included this assignment, the Guardia Civil’s jurisdiction in territorial waters is still being questioned today. This questioning comes, basically, from institutions which, at the time, carried out certain tasks that are now carried out by the Guardia Civil, or from others who claim executive powers that the current regulatory framework does not attribute to them. The regulatory arguments that support the fulfilling by the Guardia Civil (especially through the Maritime Service Division) of the different missions and tasks entrusted to them are set out below.
