The Supreme Court Ruling of October 15, 2024 addresses the issue of the reimbursement of undue benefits in the context of an administrative error by the SEPE. In this ruling, the Supreme Court establishes that, in cases in which the error leading to the undue payment of a benefit is exclusively attributable to the Administration, the beneficiary is not obliged to return the money received, provided that he has not acted in bad faith and the decision produces a disproportionate and excessive burden on him. The Court strikes a balance between the principle of good faith of the interested party and the right to property, in accordance with the doctrine established by the European Court of Human Rights in the Cakarevic case.
