    La implementación de tecnología en el sistema judicial ha modificado sustancialmente las formas de desarrollo de las audiencias. En la actualidad, una gran parte de las audiencias se lleva a cabo mediante medios tecnológicos, lo cual ha contribuido significativamente a la celeridad de los procedimientos judiciales. No obstante, dicha implementación podría estar ocasionando una serie de vulneraciones a otros principios constitucionales. Esta investigación se propone analizar si el uso de audiencias telemáticas en la litigación oral pone en riesgo el principio de buena fe y lealtad procesal, particularmente en lo referente a la manera en que se toman testimonios durante las audiencias. La relevancia de este estudio radica en la necesidad de generar conocimiento que evidencie posibles violaciones dentro del sistema actual de desarrollo de audiencias. El objetivo general de esta investigación es realizar un análisis crítico jurídico sobre la práctica de la prueba testimonial a través de medios digitales y la posible tensión con el principio de buena fe y lealtad procesal. Para cumplir con este objetivo, la investigación adoptará un enfoque cualitativo, utilizando la observación de las técnicas de litigación oral empleadas por las partes procesales dentro de las audiencias virtuales. Además, se aplicará el método inductivo-deductivo, partiendo de premisas particulares para llegar a conclusiones generales y viceversa.

    The implementation of technology in the judicial system has modified the ways hearings are conducted. Specifically, nowadays, a large portion of hearings are held through technological means, which has contributed to the speed of procedures. However, it turns out that such implementation could be causing a series of violations to other constitutional principles. This has led to the need to investigate whether the use of telematic hearings for oral litigation could put at risk the principle of good faith and procedural loyalty due to the way testimonies are taken during hearings. The relevance of this research lies in the need to generate knowledge that demonstrates possible violations within the current system of conducting hearings. The general objective of the research is to carry out a critical legal analysis of the practice of testimonial evidence through digital means and the possible tension with the principle of good faith and procedural loyalty. The research will have a qualitative approach, using the observation of oral litigation techniques employed by the procedural parties within virtual hearings. Additionally, the inductive-deductive method will be applied, starting from particular premises to reach general conclusions and vice versa.
