El delito de violación de secretos por autoridad o funcionario, o en su caso por particular, tiene relevancia por afectar su comisión al buen funcionamiento de la Administración, creando daño en todo caso al servicio público y cuando es perpetrado por particular solo es punible la conducta si se aprovecha para sí o para un tercero del secreto o información privilegiada recibida.
