    La presente investigación tiene como objetivo general determinar el carácter constitutivo o meramente declarativo de las sentencias de usucapión decenal de bienes inmuebles en Bolivia, considerando los autos supremos emitidos por el Tribunal Supremo de Justicia de Bolivia en las gestiones 2017 a 2019. Se utilizó el método dogmático jurídico, en el marco de la investigación cualitativa, con profundidad descriptiva, temporalmente sincrónica; la fuente primaria son los autos supremos emitidos por el Tribunal Supremo de Justicia de Bolivia y la fuente secundaria es la doctrina. Los resultados ponen en evidencia que hay una inclinación en la jurisprudencia boliviana hacia el carácter constitutivo de las sentencias de usucapión decenal de bienes inmuebles en Bolivia.

    The general objective of this research is to determine the constitutive or merely declaratory nature of the judgments of decennial usucapion of real estate in Bolivia, considering the supreme orders issued by the Supreme Court of Justice of Bolivia in the 2017 to 2019 proceedings. The legal dogmatic method was used, within the framework of qualitative research, with descriptive depth, temporally synchronous; the primary source is the supreme orders issued by the Supreme Court of Justice of Bolivia and the secondary source is the doctrine. The results show that there is an inclination in Bolivian jurisprudence towards the constitutive character of the judgments of the decennial usucapion of real estate in Bolivia.
