    The article examines the functions of the Court of Cassation and the performance of nomofilachy between the ius litigatoris and the ius constitutionis, then goes on to consider the relationship with the European Court of Human Rights and the Court of Justice of the European Union and comes to the conclusion that as a result of this relationship the nomofilactic function of the Court of Cassation, while partly changed, has gained greater importance because “it no longer moves within the closed national normative enclosure but... must reckon, far from easy, with the jurisprudence of the European.

    L’articolo esamina le funzioni della Corte di cassazione e lo svolgimento della nomofilachia tra lo ius litigatoris e lo ius constitutionis, passa poi a considerare il rapporto con la Corte Europea dei Diritti dell’Uomo e con la Corte di Giustizia dell’Unione Europea e giunge alla conclusione che per effetto di questo rapporto la funzione nomofilattica della Corte di cassazione, pur essendo in parte mutata, ha acquistato maggiore importanza perché «non si muove più nel chiuso del recinto normativo nazionale ma... deve fare i conti, tutt’altro che facili, con la giurisprudenza delle Corti europee, innestandola nell’ordinamento interno con interventi ricostruttivi».
