Memoria y litigio. Los debates sobre las “leyes del perdón” en Argentina y Uruguay

    En este trabajo analizamos las disputas desencadenadas en torno al proceso de anulación de las leyes de Obediencia Debida y Punto Final en Argentina y de la Ley de Caducidad de la Pretensión Punitiva del Estado en Uruguay, leyes que imposibilitaban el juzgamiento de los responsables por delitos de lesa humanidad cometidos durante las dictaduras militares de cada país y que, mediante mecanismos disímiles, fueron anuladas en 2003 y 2011 respectivamente. Ambas coyunturas configuran “escenas litigiosas de memoria”, es decir, espacios discursivos en los que se pone en juego un litigio, y en los que, por lo tanto, se dirimen asuntos que hacen a la definición de la propia comunidad política. El objetivo del artículo es reconstruir y comparar las principales quaestiones argumentativas o ejes polémicos, y los distintos posicionamientos desplegados en cada una de las escenas analizadas, con particular acento en las posturas oficiales.

    In this paper we analyze the polemical disputes about the annulment of the “Due Obedience” and “Full Stop” laws in Argentina and the Law on the Expiration of the Punitive Claims of the State in Uruguay, laws that prevented the pro- secution of those responsible for crimes against humanity during the military dictatorships and that, through different mechanisms, were cancelled in 2003 and 2011 respectively. Both situations can be studied as “litigious memory sce- nes”, i.e. discursive spaces where political litigation is held, and where issues involved in the definition of the political community itself are therefore treated.The main goal of this paper is to reconstruct and compare the main argumenta- tive quaestiones or controversies, and the different positions deployed in each of the scenes analyzed, with emphasis on official discourses.
