    El estudio de la figura del poder preventivo en el tráfico jurídico internacional o transfronterizo, y los problemas que plantea en el Derecho internacional privado español, es el objeto de esta aportación. Se pretende encontrar soluciones a las cuestiones de competencia judicial internacional, ley aplicable y reconocimiento del poder preventivo conforme a la regulación supraestatal, y, en su defecto, la estatal. El Convenio de La Haya 2000 relativo a la protección internacional de las personas adultas no ha sido firmado ni ratificado por España y solo existe un Proyecto de Reglamento sobre la materia, no obstante, nos referiremos a esta regulación en un análisis comparativo con la normativa nacional. Además, abordaremos cómo se han resuelto en la práctica doctrinal los problemas enunciados. Antes nos ocupamos del problema calificatorio, para perfilar qué se entiende por poder preventivo y distinguirlo de otras figuras jurídicas.

    The study of the figure of preventive power in international or cross-border legal traffic, and the problems it raises in the Spanish private international law, is the object of this contribution. The aim is to find solutions to the issues of international judicial jurisdiction, applicable law and recognition of preventive power in accordance with supra-state regulation, and, failing that, state regulation. The Hague Convention 2000 on the international protection of adults has not signed or ratified by Spain and there is only a Draft Regulation on the matter. However, we will refer to this regulation in a comparative analysis with national regulations. Furthermore, we will address how the stated problems have been resolved in doctrinal practice. Before we deal with the qualifying problem, to outline what meant by preventive power and distinguish it from other legal figures.
