    La medida de investigación del agente encubierto fue introducida por Ley 5/1999. Tras 30 años de uso de este mecanismo de investigación, se han planteado diferentes cuestiones dirigidas a determinar donde se encuentran los límites del agente encubierto y cuando debe solicitar una específica y adicional autorización judicial.

    La reciente sentencia del Tribunal Constitucional 87/2024, de 4 de junio, analiza los problemas relacionados con el uso del agente encubierto y el necesario respecto a los derechos fundamentales de los investigados.

    The undercover agent was created by Law 5/1999. After 30 years of use of this investigative mechanism, several questions arise in order to determinate where are the limits of the undercover agent and when a specific and additional judicial authorization must be requested.

    The recent sentence of the Spanish Constitutional Court (STC 87/2024, June 4) analyzes the problems related with the use of an underconver agent and the necessary respect for the fundamental rights of the defendants.
