    Este artículo analiza las principales posturas respecto al sistema de solución de controversias inversionista-Estado o investor-state dispute settlement (ISDS) en Esta dos Unidos y la Unión Europea. En un inicio se hace referencia a la discusión del TPP-11 en Chile, repasando las principales características del ISDS y las críticas que se han esbozado durante los últimos años. Posteriormente se procede a estudiar los ámbitos espaciales mencionados, identificando en cada uno de ellos su postura tradicional con respecto al sistema, las nuevas propuestas y, finalmente, los tratados de nueva generación que han suscrito

    This article analyses the main positions on the investor-state dispute settlement system (ISDS) in the United States and the European Union. First, reference is made to the discussion of the TPP-11 in Chile, reviewing the main characteristics of ISDS and the criticisms that have been outlined in recent years. It then proceeds to study the aforementioned spatial spheres, identifying in each of them their traditional position with respect to the system, the new proposals and finally the new generation treaties they have signed
