La Ponderación y Su Efecto en el Positivismo Jurídico

    En el presente trabajo de investigación, como objetivo general, se planteó Determinar en qué medida el empleo de la ponderación afecta al positivismo jurídico. Para alcanzarlo, se utilizó uno de los diseños del enfoque cualitativo: el diseño fenomenológico. Así, mediante la técnica de la entrevista y la utilización —como instrumento de recolección de datos— de la guía de entrevista, se logró determinar que existe la necesidad de regular de mejor manera el empleo de la ponderación en el Perú. Con respecto a las conclusiones —gracias a los resultados y su discusión—, se obtuvieron tres conclusiones. Primero, el abogado experimentado, tiene marcada posición respecto al tema en cuestión, existen posiciones a favor y en contra, denotando ambas posiciones sólidos conocimientos sobre el tema en estudio. Segundo, se ha logrado conocer que existe un porcentaje mayor que refiere que el empleo de la ponderación, equivale a la inseguridad jurídica, lo cual es peligroso y no aceptable en un sistema positivista. Tercero, se ha logrado conocer que el empleo de la ponderación en los sistemas positivistas ha generado beneficios sociales en la solución de conflictos.

    In this research work, as a general objective, it was proposed to determine to what extent the use of weighting affects legal positivism. To achieve this, one of the designs of the qualitative approach was used: the phenomenological design. Thus, through the interview technique and the use—as a data collection instrument—of the interview guide, it was possible to determine that there is a need to better regulate the use of weighting in Peru. Regarding the conclusions—thanks to the results and their discussion—three conclusions were obtained. First, the experienced lawyer has a clear position regarding the topic in question, there are positions for and against, both positions denoting solid knowledge about the topic under study. Second, it has been found that there is a higher percentage that reports that the use of weighting is equivalent to legal uncertainty, which is dangerous and not acceptable in a positivist system. Third, it has been known that the use of weighting in positivist systems has generated social benefits in the resolution of conflicts.
