    La inexistencia desde sus orígenes ha sido una figura oscura, de difícil definición con disímiles posturas por parte de la doctrina europea y diversas contradicciones en la recepción por la jurisprudencia colombiana, sin embargo, hemos agrupado las tesis del derecho francés, español e italiano en cuatro grandes vertientes, para posteriormente compararlas con la jurisprudencia colombiana, la cual ha sido diversa y contradictoria en su evolución, con el fin de hacer un aporte en el proceso de unificación, garantizar los derechos a la igualdad, seguridad jurídica y legitima confianza.

    The non-existence since its origins has been a dark figure, difficult to define with dissimilar positions on the part of the European doctrine and diverse contradictions in the reception by the Colombian jurisprudence, however, we have grouped the theses of the French, Spanish and Italian law in four great aspects, to later compare them with Colombian jurisprudence, which has been diverse and contradictory in its evolution, in order to make a contribution to the unification process, guarantee the rights to equality, legal security and legitimate trust.
