La excepción del interés nacional se encuentra recogida en múltiples legislaciones y también en instrumentos internacionales. En este trabajo se examina el papel que cumple, qué condiciones han de darse para que opere y cómo se regula tanto en el Reglamento Roma I como en el DIPr español de origen interno. Se analiza también la reciente reforma del art. 10.8 del CC, que ha transformado de forma profunda la regulación de la excepción en el DIPr español de fuente interna.

Domestic law in many countries and several international instruments apply the doctrine of national interest. This work examines the role it plays, what conditions must be met for it to operate and how it is regulated both in the Rome I Regulation and in the Spanish domestic Private International Law. The recent reform of art is also analysed. 10.8 of the CC, which has profoundly transformed the regulation of this doctrine in the Spanish domestic Private International Law.
