    Los peritajes neuropsicológicos son clave en las impugnaciones de testamentos, ya que relacionan las funciones cognitivas del testador con su capacidad para otorgar actos jurídicos de manera libre y meditada. Determinan si el deterioro cognitivo, causado por enfermedades neurodegenerativas u otras que afecten al cerebro, compromete la facultad del individuo para expresar su voluntad. La neuropsicología forense realiza este análisis mediante evaluaciones en vida o, en caso de fallecimiento, a través de una autopsia neuropsicológica que esclarece si el testador tenía la capacidad necesaria.

    Neuropsychological expert reports are a key element when it comes to contesting wills, since they link the cognitive functions of the testator with their capacity to execute legal acts in a free and considered manner. They determine whether cognitive impairment, caused by neurodegenerative or other diseases that affect the brain, compromises an individual person’s ability to express their will. Forensic neuropsychology carries out such an analysis by assessing the subject when alive or, in the event of death, by means of a neuropsychological autopsy that clarifies whether or not the testator possessed the required capacity.
