    With this article, we wish to shed light on a new perspective on the donation revocation regime. in particular, we intend to reflect on the solution of the articles 970.º and 974.º of the Portuguese Civil Code in light of a new consideration. Thus, it becomes necessary to analyse the precepts in question taking into account the reason for being of the figure of revocation due to ingratitude in the scheme of the donation contract to, afterwards, elaborate a systematic critique in which we defend the lack of constitutional conditions for its preservation in our legal system.

    Com o presente artigo, desejamos lançar uma nova perspetiva sobre o regime da revogação da doação. Em particular, pretende-se refletir sobre a solução dos artigos 970.º e 974.º do Código Civil Português à luz de uma nova ponderação. Assim, torna-se necessário analisar os preceitos em questão atendendo à razão de ser da figura da revogação por ingratidão no regime do contrato de doação para, posteriormente, se elaborar uma crítica sistemática onde sustentamos a falta de condições constitucionais para a sua preservação no nosso ordenamento jurídico.
