The new constitutional paradigm of state liability as established in Article 90 of the Constitution forms the foundation for the applicability of objective liability regimes (special damage and exceptional risk). These two grounds for liability are applicable in exceptional cases. One such case is terrorist attacks, and it is on this subject that a literature review will be conducted to determine the elements and way the State can be held liable for patrimonial damage in the event of a terrorist attack. This article is developed within that context, aiming to ascertain, through a bibliographic review, the hierarchy that should exist for the application of the objective liability regime of exceptional risk, and subsidiarily, special damage, in the case of terrorist attacks. A review was conducted in the main databases of the most recent research articles related to the proposed theme to achieve this objective. The conclusion reached is that the consulted authors agree on the necessity of a hierarchy between the two regimes of state liability in cases of terrorist attacks, with exceptional risk being the primary recourse.
