In contrast to the already consolidated doctrine of the Supreme Court on the application of the principle of good administration in tax proceedings, and, especially in the event of silence on the part of the Administration, the extension of the penalising effects for the latter to the scope of the prescriptive institute still lacks specific doctrine in this regard that would allow the pure and literal regulation of the General Tax Law on the prescription of the right to a refund of income to be ircumvented Improper. The question of whether or not to apply the prescriptive institution of the right of the individual to the refund of undue income in the face of the inactivity of the Administration, would so far have two opposing solutions, protected by two constitutional principles, such as the one of legal certainty that protects the figure of limitation and the one of good administration that would endorse the opposite solution. And we say for the moment, since the expected and foreseeable doctrine of the Supreme Court would seem to point to the full applicability of the principle of good administration also in this area of limitation.
