Resumen de Regulación del derecho del patrimonio cultural: derecho comparado entre México y España

El artículo compila y analiza el marco jurídico vigente tanto nacional como internacional del patrimonio cultural, tangible e intangible, en los Estados Unidos Mexicanos. Esta categoría esencial del derecho cultural cuenta con estándares internacionales que tanto la República Mexicana como el Reino de España comparten, no solo por considerarse normas convencionales del bloque de constitucionalidad, sino por ser altas partes contratantes de los instrumentos jurídicos internacionales en la materia del sistema universal de protección de los derechos humanos. A partir del método micro-comparativo estructuralista se analizan las semejanzas y diferencias en la forma de implementación de dichos estándares en su regulación interna.

The article compiles and analyzes the current legal framework, both national and international, of cultural heritage, tangible and intangible, in the United Mexican States. This essential category of Cultural Law has international standards that both the Mexican Republic and the Kingdom of Spain share, not only because they are considered conventional norms of the constitutional block, but also because they are high contracting parties of the international legal instruments on the subject of the human rights universal system protection. Using the structuralist micro-comparative method, the similarities and differences in the way these standards are implemented in their internal regulation are analyzed.
