    El presente artículo expone desde una perspectiva dogmático constitucional, el derecho al ambiente en Portugal, tomando como referencia la Carta Política portuguesa, así como los desarrollos doctrinales más importantes en materia de derechos fundamentales. A partir de la definición de derecho fundamental, desentraña el alcance de este importante derecho para establecer si es subjetivo, si es obligación del Estado, las consecuencias de su naturaleza y por último su justiciabilidad y eficacia.

    The present article sets forth, from a constitutional doctrinal perspective, the right to the environment in Portugal, drawing on the Portuguese Political Charter as well as the most significant doctrinal developments regarding fundamental rights. Beginning with the definition of a fundamental right, it unravels the scope of this significant entitlement to determine whether it is subjective, whether it is an obligation of the State, the consequences of its nature, and finally its justiciability and effectiveness.
