Nuevas afectividades, nuevos derechos: Una tensión con la permanencia y estabilidad jurídica en Uruguay y Paraguay

    El presente artículo repasa las etapas y vicisitudes que ha seguido la institución del matrimonio y la familia en las respectivas historias de Uruguay y Paraguay. Con esos antecedentes se analiza luego la realidad actual de las nuevas afectividades, que dan lugar a variadas formas de unión entre personas y de núcleos familiares, y el papel que la legislación y la jurisprudencia han tenido en su desarrollo y legitimación. En un ejercicio de derecho comparado se plantean las diferencias y similitudes sobre el tema, en los ordenamientos jurídicos de ambos países, aparentemente diferentes en su conformación social y religiosa, pero con un origen común. De esta forma, finalmente, se realiza una valoración sobre el respeto y la promoción de la libertad religiosa en el contexto de los nuevos derechos y nuevas realidades de tipo afectivo y familiar, en tensión con la permanencia y estabilidad jurídica.

    This article reviews the stages and vicissitudes that the institution of marriage and family has followed in the respective histories of Uruguay and Paraguay. With this background, the current reality of the new emotions is then analyzed, which give rise to various forms of union between people and family units, and the role that legislation and jurisprudence have had in their development and legitimation. In an exercise of comparative law, the differences and similarities on the subject are raised in the legal systems of both countries, apparently different in their social and religious makeup, but with a common origin. In this way, finally, an assessment is made of the respect and promotion of religious freedom in the context of new rights and new emotional and family realities, in tension with legal permanence and stability.
