Sistema matrimonial y familiar en Brasil

    La realidad familiar está sufriendo cambios drásticos, afectando directamente conceptos jurídicos relacionados con la familia, urge considerar instrumentos jurídicos relacionados con las familias, así como nuevas realidades familiares. Lo cierto es que el concepto de familia ha ido cambiando a lo largo de la historia, sin embargo, siempre está asociado al estilo de vida de cada persona, resultado de la forma en que se organiza la sociedad y el Estado. En Brasil, la Constitución Federal (CF) brasileña refuerza esta idea diciendo: “La familia, fundamento de la sociedad, está especialmente protegida por el Estado”. Pero ¿qué familias están protegidas por el Estado? ¿Cómo se define la familia en el sistema jurídico brasileño? ¿Se consideran familiares las nuevas realidades familiares, como el matrimonio entre personas del mismo sexo? El objetivo de este estudio es investigar, a partir de un análisis histórico de las Constituciones brasileñas, así como del derecho civil brasileño, la realidad del sistema jurídico familiar, tratando principalmente de investigar si nuevas realidades familiares, como las uniones entre personas del mismo sexo, y las formas familiares tradicionales, como el matrimonio entre un hombre y una mujer, y las formas familiares culturales, como el matrimonio indígena, tienen protección y provisión en el sistema jurídico brasileño.

    The family reality is undergoing drastic changes, directly affecting legal concepts related to the family, it is urgent to consider legal instruments related to families, as well as new family realities. The truth is that the concept of family has changed throughout history, however, it is always associated with each person's lifestyle, a result of the way society and the State are organized. In Brazil, the Brazilian Federal Constitution (CF) reinforces this idea by saying: “The family, the foundation of society, is especially protected by the State”. However, which families are protected by the State? How is family defined in the Brazilian legal system? Are new family realities, such as same-sex marriage, considered familiar? The objective of this study is to investigate, based on a historical analysis of the Brazilian Constitutions, as well as Brazilian civil law, the reality of the family legal system, mainly trying to investigate whether new family realities, such as same-sex unions, and the Traditional family forms, such as marriage between a man and woman, and cultural family forms, such as indigenous marriage, have protection and provision in the Brazilian legal system.
