How are human rights grounded in well-bieng? In this paper, Professor James Griffin tries to give an answer to the crucial question, focusing on a current -and pratical- clash between Europe and Islam concerning the freedom of expression:
«The Rushdie affair». This is achieved by two ways: first througth the delineation of a substantive theory of rigths; and secondly, by way of an argument that tries to arrive ata solution for conflicts with liberty, namely, liberty of cult vs. liberty of expression. An answer to the question about Rusdie's apparent exceeding the limits of liberty is proposed by means of the author's original concepts of personhood and practicalites. Finally, the diversity of conceptions about the «holy>) is pointed out as one of the origins of the conflict. A clear defence of the primacy of liberty of expression is argued: «In future, Muslim children, Christian children, all children will grow up spontaneously questioning their way of life. The only defence is, not suppresing the questions, but having sorne answers».
