Una victoria pírrica, difícilmente expansiva, sobre reintegro de gastos sanitarios padecidos en la primera ola de la pandemia del coronavirus: Comentario a la Sentencia del Tribunal Supremo 682/2024, de 8 de mayo

    La Sala de lo Social del Tribunal Supremo reconoce el derecho del recurrente al reintegro de sus gastos sanitarios efectuados en hospital privado, en la primera ola de la pandemia del coronavirus. El recurrente obtiene una victoria pírrica, por causa del importe de los gastos objeto de reintegro, y difícilmente expansiva a otros supuestos de reintegro, por causa del contexto pandémico en que se desenvuelve. La reforma de la norma reguladora del reintegro de gastos podría tratar de evitar este tipo de victorias pírricas en el futuro.

    The Social Chamber of the Supreme Court affirms the right of the appellant to reimbursement of his health care expenses paid to a private hospital during the first wave of the coronavirus pandemic. The appellant obtains a pyrrhic victory, due to the amount of the expenses to be reimbursed, and it is difficult to expand to other cases of reimbursement, due to the pandemic context in which it takes place. The reform of the provision regulating the reimbursement of expenses could try to avoid this type of pyrrhic victory in the future.
