Resumen de Expectativas para la configuración del listado positivo de animales silvestres de la Ley 7/2023

El presente artículo profundiza en el estudio de la figura del listado positivo o listados positivos, introducida por la novedosa Ley 7/2023 de 28 de marzo, de protección de los derechos y el bienestar de los animales. En este sentido, en primer lugar, se lleva a cabo una primera aproximación a la naturaleza de la nueva Ley 7/2023, para a continuación analizar en qué consiste el listado positivo de animales, así como explicar la vigente disposición transitoria segunda, precepto esencial desde la entrada en vigor de la norma hasta la futura aprobación de los distintos listados positivos, a través de norma reglamentaria. Posteriormente, se procede con un análisis de parte de la normativa autonómica relevante para intentar entrever cuál será el sentido que tomará el futuro listado positivo de animales, habida cuenta de la relativamente reciente entrada en vigor de esta normativa autonómica, y que puede considerarse una referencia válida para la nueva norma de rango legal estatal. Finalmente, se aboga por proponer un procedimiento de elaboración de los listados positivos y se intenta dilucidar cuál habrá de ser, a grandes rasgos, el contenido de estos listados positivos, haciendo especial mención a aquellos animales que pudieran ser considerados peligrosos debido a su veneno.

This article delves into the study of the figure of the positive list or positive lists, introduced by the new Law 7/2023 of March 28, on the protection of the rights and well-being of animals. Firstly, a first approximation to the nature of the new Law 7/2023 is carried out, to then analyse what the positive list of animals consists of. This also allows explanation of the current second transitional provision, an essential precept since the entry into force of the standard until the future approval of the different positive lists through regulatory standards. Subsequently, we proceed with analysis of part of the relevant regional regulations to try to glimpse what meaning the future positive list of animals will have, taking into account the relatively recent entry into force of these regional regulations, and which can be considered a reference valid for the new state legal rank standard. Finally, we propose a procedure for preparing positive lists and an attempt is made to elucidate what, broadly speaking, the content of these positive lists should be, making special mention of those animals that could be considered dangerous due to their poison.
