    El artículo ofrece un panorama de la discusión sobre el castigo del excluido social, ordenándola en torno a sus dos ejes principales –el moral y el político– y a cinco de sus dimensiones más debatidas por la doctrina. A su vez, se esgrime la hipótesis de que el teoría penal, sin ser un instrumento de cambio social, tampoco debe abstraerse del hecho de que buena parte de los castigos en las sociedades contemporáneas se imponen en condiciones muy diferentes de las que imaginan las teorías (políticas) de la pena; y que esa dis­tancia debe ser objeto de crítica, en primer lugar, y fuente de consecuencias dogmáticas, en segundo.

    The article offers an overview of the discussion on the punishment of the socially excluded, arranging it around its two main axes – the moral and the political – and five of its most debated problems. At the same time, the hypothesis is put forward that penal theory, without being an instrument of social change, should not be abstracted from the fact that, to some extent, punishments in contemporary societies are imposed in conditions that differ from those imagined by the (political) theories of punishment; and that this distance should be the object of criticism, in the first place, and a source of legal consequences, in the second.
