Resumen de El decaimiento de la resolución de calificación ambiental: Comentarios sobre la sentencia r-280-2021 del segundo tribunal ambiental

  Este comentario analiza una sentencia del Segundo Tribunal Ambiental sobre el decaimiento administrativo de la Resolución de Calificación Ambiental (RCA). Revisa el estado del arte y el razonamiento del tribunal, identificando la procedencia de la figura, la competencia de la judicatura ambiental y su paralelo con otras figuras. Concluye que una RCA puede perder su objeto durante la evaluación ambiental, activando el decaimiento; que el Comité de Ministros puede pronunciarse sobre esto en la fase recursiva administrativa, haciendo extensible su revisión a los Tribunales Ambientales en la fase contencioso-administrativa y; que la procedencia del decaimiento debe diferenciarse de otras figuras que buscan dejar sin efecto un acto administrativo que perdió su validez, evaluándose de manera casuística.

  This commentary analyzes a decision of the Second Environmental Court on the administrative decay of the Environmental Qualification Resolution (RCA). It reviews the state of the art and the reasoning of the court, identifying the origin of the figure, the competence of the environmental judiciary and its parallel with other figures. It concludes that an RCA can lose its purpose during the environmental evaluation, activating the decay; that the Committee of Ministers can pronounce on this in the administrative appeal phase, making its review extensible to the Environmental Courts in the contentious-administrative phase and; that the origin of the decay must be differentiated from other figures that seek to leave without effect an administrative act that lost its validity, being evaluated on a case-by-case basis
