Resumen de Régimen jurídico alemán y chileno en materia de experimentación clinica en animales

El artículo coloca en perspectiva los regímenes jurídicos de la experimentación en animales alemán y chileno basado en seis criterios, referencia constitucional, referencia legal y reglamentaria, naturaleza jurídica, autorizaciones y procedimientos, fiscalización y sanción y gobernanza. Mientras que en Alemania la regulación es densa y detallada con importante intervención estatal, el sistema chileno se caracteriza por la preeminencia de la autoregulación de las instituciones que llevan a cabo este tipo de actividades. Problemas comunes de aplicación y eficacia normativa de los estatutos, debido al carácter eminentemente privado y restringido donde se llevan a cabo, que pretende ser compensado con obligaciones de reporte y monitoreo son identificados. Los estándares internacionales de la comunidad científica, en particular los principios de las 3R (reducción, reemplazo y refinamiento) juegan un rol supletorio importante en la medida en que el incentivo general es la reproductibilidad de la investigación, por lo que un animal sin bienestar puede perjudicar los resultados

The article puts into perspective the legal regimes of German and Chilean animal experimentation based on six criteria: constitutional reference, legal and regulatory reference, legal nature, authorizations and procedures, control and sanction and governance. While in Germany the regulation is dense and detailed with significant state intervention, the Chilean system is characterized by the preeminence of self-regulation of the institutions that carry out this type of activities. Common problems of enforcement and regulatory effectiveness of the statutes, due to the eminently private and restricted character where they are carried out, which is intended to be compensated with reporting and monitoring obligations are identified. The international standards of the scientific community, in particular the 3R principles (reduction, replacement and refinement) play an important supplementary role insofar as the general incentive is the reproducibility of the research, so that an animal without welfare can harm the results. The main conclusions of the research is that both systems coincide in the application of international standards, but differ, for example, in the role of the State in the surveillance of experiments.
