La jurisprudencia chilena de la Ley 19.496 abunda en casos donde la ventaja jurídica y económica que la empresa detenta en el mercado es explotada en perjuicio de los derechos del consumidor. En este trabajo se analizan cuatro zonas del mercado donde el desequilibrio de posiciones entre empresario y consumidor se extrema: el mercado financiero, el inmobiliario, el de agencias de viaje y transporte aéreo y el automotriz. El consumidor real de estas relaciones es un consumidor débil que requiere instrumentos de protección más eficaces.
The chilean jurisprudence of Act number 19.496 abounds in cases where the legal and economic advantage that the company holds in the market is exploited to the detriment of consumer rights. This paper analyzes four areas of the market where the imbalance of positions between the entrepreneur and the consumer is extreme: the financial market, real estate, travel agencies and air transport, and the automotive market. The real consumer in these relationships is a weak consumer who requires more effective protection instruments.
