    Este ensayo busca explorar y poner de relieve el potencial reinsertador de la aplicación de acciones de justicia restaurativa en el tratamiento penitenciario de los internos de las Instituciones Penitenciarias, así como la inclusión de los intereses de las víctimas y sus necesidades en la búsqueda de una solución definitiva para el conflicto social surgido del delito. La diferenciación entre la Mediación Penal y el Tratamiento Penitenciario Restaurativo, así como la distinción entre el daño reparable en el proceso penal y el daño sufrido por la víctima, deben ser el punto de partida para el diseño y aplicación de acciones concretas y específicas destinadas a la superación del daño causado por la acción delictiva.

    The essay seeks to explore and highlight the reinsertion potential of the application of Restorative Justice actions in the Penitentiary Treatment of the inmates of the Penitentiary Institutions, as well as the inclusion of the interests of the victims and their needs in the search for a definitive solution to the social conflict arising from the crime. The differentiation between Criminal Mediation and Restorative Penitentiary Treatment, as well as the distinction between reparable damage in criminal proceedings and the damage suffered by the victim, should be the starting point for the design and application of concrete and specific actions aimed at overcoming the damage caused by the criminal action.
