    Uno de los aspectos controvertidos en el procedimiento de imposición de medidas de seguridad para enajenados mentales en el ordenamiento jurídico chileno es el relativo a la determinación de la extensión de las medidas de seguridad. Este trabajo tiene por objeto proponer ciertas reglas con el fin de precisar los límites máximos y mínimos que prescribe el artículo 481 del Código Procesal Penal, con base en los principios de proporcionalidad y necesidad. Asimismo, analizar las diversas interpretaciones que los tribunales superiores de justicia han efectuado de la norma referida.

    One of the controversial aspects in the procedure for imposing security measures for mentally ill persons in the Chilean judicial system pertains to the determination of the extension of the security measures. This paper seeks to propose certain rules in order to specify the maximum and minimum limits prescribed by article 481 of the Criminal Procedure Code, based on proportionality and necessity principles. And to analyze the different interpretations that the high courts of justice have made of the referred norm.
