The Supreme Court of Spain gives procedural standing to third parties, who by agreement or contract acquire the obligation to pay a local tax, so that theycan request the rectification of the self-assessment and request the eventual refund of undue income so that they can appeal administrative acts, including access to the Contentious-Administrative jurisdiction. It is also stated that the Administration cannot omit its duty to resolve and benefit from its own non-compliance, which is why it must always provide an express, reasoned and timely resolution of its administrative acts and cannot oblige the taxpayer or interested party to exhaust administrative channels when it does not resolve promptly and ends the proccdures with a presumed rejection, as a result of negative administrative silence.
