    El propósito de esta investigación es determinar el título de imputación del extraneus por su participación necesaria en el delito funcionarial de colusión, según criterio jurídico, teoría doctrinaria, y jurisprudencia. Los resultados han revelado que al extraneus le corresponde el título de imputación de “cómplice”, a la luz de la Teoría de Infracción de Deber y la Teoría de la Unidad del Título de Imputación con base en el Principio de Accesoriedad de la Participación como criterio jurídico, y jurisprudencia nacional vinculante; concluyendo que el título de imputación del extraneus es de cómplice por ser partícipe necesario en la comisión del delito funcionarial de colusión, no pudiéndosele imputar como autor ni coautor, al no estar investido del deber especial penal (funcionario o servidor público) que exige la norma y por contribuir accesoriamente en el ataque al bien jurídico en unidad de intenciones con el intraneus.

    The purpose of this investigation is to determine the charge of the extraneus for his necessary participation in the official crime of collusion, according to legal criteria, doctrinal theory, and jurisprudence. The results have revealed that the stranger is entitled to the imputation title of “accomplice”, in light of the Theory of Violation of Duty and the Theory of the Unity of the Imputation Title based on the Principle of Access to Participation as a criterion. legal, and binding national jurisprudence; concluding that the title of accusation of the stranger is that of accomplice for being a necessary participant in the commission of the functional crime of collusion, and he cannot be charged as author or co-author, as he is not invested with the special criminal duty (official or public servant) required by the norm and for contributing accessory to the attack on the legal good in unity of intentions with the intraneus.
